    There are ways to articulate it.

    Night

    Fence establishing curtilage (i.e. a secure area), the crossing of which demonstrates intent.

    Suspect's actions were reasonably prepatory to a violent felony

    She'll have some explaining to do, but I think she will be good based on what I have heard so for.

    DA Garza calls chief >chief calls asst chief > asst chief threatens witness to a case > asst chief on the hook but no action seen for Chief or the DA. I think they are "letting it slide" for the chief since he won't be the permanent chief. Some animals are more equal than others and sometimes justice is more equal for them too.

    If there is someone in my backyard, and they have not threatened me, or made any attempt to get in my house, I can legally shoot them through the wall?

    A dude in your fenced back yard, at night peering into your bedroom IS a threat and a pretty major one where you could be seconds away from becoming the victim of a violent felony.

    The belief does have to be reasonable. I.e. you can't see someone on the sidewalk and "think they might"

    Or see someone with hands in their pockets and "think they might"

    "Reasonable belief based on the totality of the circumstances" is what you you are looking for.

    For example. The dead guy had been seen and was hanging around long enough for our notavictim to get a rifle and make it ready and possibly give a verbal warning then shoot the dead guy dead as he continued to leer through the window. Which is a lot different than seeing someone at a window then after you get back with your gun shooting them as they walk away, or if you had your gun in hand blasting at first sight without developing any belief about the circumstances.
