Restaurant industry activists are lobbying Congress to legislate insurance companies into to retroactively re-write BI contracts for business interruption coverage to force insurers into covering losses created by political and business continuation decisions made locally.

If this passes Congress, you can kiss business interruption insurance good-bye.

You can thank these people threatening to sue in each of the 50 states if insurers don’t wholesale agree to their demands.

I've seen lots of dentists agitating about this. I didn't even pull out my policy - I'm limping along & I don't think my BI policy was intended to cover this.

Bankrupting insurance companies will not help anyone. Also, I am contractually required to have BI insurance by my landlord. If these suites are successful my insurance rates will bankrupt me. Can I sue Wolfgang Puck for that?

This reminds me of the push to wipe out student loans. Those of us that prepared & acted responsibly will be made fools by the FSA.

Do you know who the Texas plaintiff is?

I doubt the lawsuit goes anywhere. The insurance policies are clear on what is covered and what is not. My guess is, it becomes like terrorism coverage. You have to opt in/ opt out of pandemic coverage in the future.

On another note, are you opening back up? My daughter was telling me about how dentist, chiropractors, etc. are all opening back up because they believe they are part of the non-essential medial procedures that the Governor is allowing as part of his loosened restrictions. But that's just stuff she's been seeing on fakebook.

I used to do this for a living. PLEASE check your policy and file for this if available. If you do, have all your financials prepared.

I don’t, but considering CIA is one of the partners and there’s CIA schools that operate ‘teaching’ restaurants in the big 5 cities, you can bet they’re one of them.

Seems like just look for any place that has a ‘celebrity’ chef and you’ll get warm.

I stayed open for emergencies the whole time. I'm not sure what I'll do regarding elective surgery. The original order expires this week but the new order isn't clear. I'm waiting for clarification from the medical & dental boards.

The lawsuits exist to support the lobbying effort. What remains to be seen is what the state Insurance Commissioners have to say about it. Pretty sure those 50 people don’t want Congress to pass legislation that tells them how to do their jobs, and pretty sure they don’t want industries for threaten their domain either. The litigants appear to be setting up a catch-22; It’ll be interesting how this turns out.
