    If you punched someone in the face and didn't cause bodily injury, it would be assault by contact.....a ticket. In this case, her penalties are more severe, so they have a different process. I too am curious on the outcome.

    No, it would be ABI. Pain counts as injury. That's why it's a felony to punch a cop.

    Okay...sure......an action against the officer is enhanced. If there's no mark or the victim states there's no lasting pain, it's Assault Contact. Reading it and charging it are two seperate things. Been there and done that. Pending the DA, I've had them go many different ways with it. Either way in this case of the video, I don't see how that officer wouldt lose her job. I've been in chases where someone else caught them, I've never had the desire to sucker punch/slap them in handcuffs. She clearly had no reason, bet she wouldn't have done it had she known the camera was on.

    Depends a bit on the state, too. I remember Michigan's assault law, you didn't have to make contact. An swing that was meant to connect that didn't was simple assault there.

    He's saying in his jurisdiction the County Attorney prosecutes those types of assault that way. But, the penal code does clearly state that an assault which causes pain is assault with bodily injury.
