New guy here so please be kind.

I'm moving to Texas in a few months. I'm coming from NJ and am fairly up to date on NJ firearms sale/possession law. Texas is a VERY different place. If anyone can give a Reader's Digest synopsis of what is gtg as far as private sales I'd really appreciate it.
And, honestly, how do I purchase from a FFL? What paperwork do I need when I walk in, etc?
I'm trying to get my ducks in a row and don't want to be completely ignorant when I get down there.

    Thanks a bunch.

If you can legally own a firearm, you are good. Just have a TX DL or receipt for a TX DL and fill out the 4473.
Is that for handgun and long gun?

In NJ, we used to be able to do private sales but Murphy and his AG got rid of those. Even then, private parties had to fill out COE/4473 and if it was a handgun a Pistol Permit had to be filled out and mailed in.

I haven't bought anything from a store in a while, but it appears one can check non-binary on the new May 2020 rev if the 4473...

Private sales are good to go. The only restriction is the seller cannot sell to someone he knows to not be legally able to own a firearm. Long guns or pistols. You only have to fill out a 4473 if you purchase through a dealer. And you can skip the background check if you have a Texas LTC (license to carry).

Private sales for private property, like guns, require nothing. It's good practice to ensure your selling to a texas resident. Some like to see a Carry permit but not required. Most want to see a TX drivers license. That's it.

Really retarded, er ignorant, er well stupid, well some insist on a bill of sale but it absolutely not required and most folks dont want personal identity info floating around nowadays. No recording or copying of Drivers license info etc. Just see a texas DL to ensure residency. Think identity theft or future burglary etc.

I personally, as well as most others, wont even buy from someone insisting on copying IDs and Bill's of sale.

In a FFL holders store you walk in, prove your a resident with your ID and appropriate alternative paperwork fill out the 4473 get thr background check and walk out. If you get the TX license to carry the background check is waived.

    No extra hoops.

No New Jersey bullshit. So leave all that crap there.

Remember you are a REFUGEE not a MISSIONARY. You ASSIMILATE into TX you dont try to change TX. Wipe your feet at the border so you dont track NJ shit all over and close the gate behind you. We have enough phucktards who just wonder in from other states.

I just came across this, and once living in the state, a person to person purchase does not appear to need anything but cash, and carry, especially since the TX DPS (DMV equiv.) is WAY behind regarding TX Drivers Licenses with all the non-free-state refugees seeking asylum... :D

I did read that officially, residency is a year... for college enrollment?

30 days residency for the Texas Dept. of Public Safety (DMV Equiv), Drivers Lic.
...if one cares about paperwork, in the free-state of Texas... :)

    Dallas Texas or so
If I lived in DFW Houston Austin metro areas, I would check nearby rural counties for a DL appointment. The receipt is good for purchase from a FFL dealer. Though some dealers may not allow that, it is legal.

Get your TX DL ASAP. Fill out 4473 Form at the gun store, wait perhaps 15-20 minutes, and if you clear, go home with your new purchase. If buying from private party, a TX DL will be requested by seller in majority of sales. If you plan to purchase more guns down the road, getting an LTC (license to carry) may be worth it just for eliminating the background check and save time (Constitutional Carry starts in Sept).

And yes, please do not bring leftist state garbage to Texas. Nothing worse than a leftist Democrat-voting gun owner moving to God's Country. Worse than 2-headed snakes.

I moved here in 2016, arrived on a Friday and Wednesday went in and changed DL and vehicle registration. DL came in the mail one week later, bought a firearm the same day. As others have said all you need is the DL.

There are no state laws regarding purchase or sale of firearms that I'm aware of. Only federal law applies. It's summarized in the ATF's brochure "Best Practices: Transfers of Firearms By Private Sellers".

    [url\https://www.atf.gov/file/58681/download[/URL]

Briefly, an unlicensed seller can transfer a firearm to a person residing in the same state as long as they have no reason to believe the buyer is not prohibited from possessing firearms.

I'm not suggesting you or anyone try this, but I think that specific wording (more accurately the specific wording of the law it's extracted from) would allow a resident of state A to travel to state B and while in state B sell a firearm to a resident of state B who is not a prohibited person. I'm curious if any armchair lawyers have an opinion or know of precedent on that.

Establish Texas as your domicile as soon as you possibly can - sign a lease, go into contract on a sale, etc.

Apply for your TX driver's license once that's done. You can buy a gun from an FFL with proof of a TX DL.

As stated above, private sales require NO permit-to-purchase, FOIDs, carry permits, bills of sales, or anything else. You can even receive or ship a gun to/from a private party who is a TX resident!

If you want to keep it that way, NEVER VOTE FOR A DEMOCRAT!

    1. Careful about showing weakness going into a discussion on this Forum…signs of weakness are engaged savagely…

    2. LOL! Folks from free states are fully aware of the horrific gun laws in socialist states. But it’s rarely the other way around…

    3. Both parties should have TX ID (or CHL = better), and then mutually agreed cash or trade. Shake hands. Go on with life!

    4. Cash, check, or card and ID from #3 above.

    5. Buying/selling is easy peasy here in the Republic. Just don’t tell them you are from Jersey until after the deal is done or they will charge you the “Damn Yankee” tax.

Freebie…when anyone asks you if you’re a “Yankee”, they ain’t talking baseball. Just tell them “I’m a damn Yankee!” That’s a Yankee who’s here to stay, not just visit. LOL!

    p.s. I’m a damn Yankee myself…

    Welcome!
