    I am giving the ATF the benefit of the doubt that they would not go after someone who engaged in an occasional sale, even if a profit was made.

    Without entrapment (ATF buys from you directly) or actual observation of your sale to anyone, how can they “prove” there was a sale unless someone is caught with a firearm that was not “registered” to them as in the current NFA items (perhaps the actual goal)?

    From their rule, you advertised a firearm or multiple firearms for sale.
    Even a single firearm transaction, or offer to engage in a transaction, when combined with other evidence, may be sufficient to require a license.

    And
    … a person would be presumed to be engaged in the business of dealing in firearms when the person: (1) sells or offers for sale firearms, and also represents to potential buyers or otherwise demonstrates a willingness and ability to purchase and sell additional firearms; …
    Among other things.

    So you throw up an FSOT, get an offer and later give a buyer rating/review on the forum to the effect you would sell to him again.

    Or, you state in the ad a BOS is required, which is a transaction record, something FFLs have to do, so if your already keeping records, it’s presumed you’re dealing w/o a license.[/quote]

    But his boys have to do a legal transfer at ffl to inherit them?
    It all backdoor registration.

    So, does that mean they can't be passed on to relatives, or friends?

    That part is unclear in the vagary of the rule.

    My take is this rule is written under the myth that a paper trail can be created for every transfer without considering how the real
    world works.
