It was almost the perfect storm.
yeah it sure was. In order for botham to die, dozens of innocuous events had to occur, all working against.
It was almost the perfect storm.
If the reports we are getting are accurate then I agree with you. I dont see how it could be murder but I DO see negligent homicide there for sure.I don’t think it’s a question of if her actions were excusable. I think the question is what the charge should be.
I haven’t seen any posts implying she should walk away from this.

So if you walk into your own dark home, find a large man inside, you draw down and give commands that are ignored while you are in full police uniform you don't think there is a legal justification for deadly force?
Woohoo. Finally caught up.RUUUUN FOOOOREST!!!
How you state it I would think no. Ignored commands is vague. But I've read a post after this that says he stood up and advanced. That is a yes. That distance can be covered in a split second. So if you walk into your own dark home, find a large man inside, you draw down and give commands that are ignored while you are in full police uniform you don't think there is a legal justification for deadly force?

If I was in my own home, not guilty of any crime, and there's a person pointing a gun at me and giving me "commands", I would think home invasion first and would see myself legally justified in employing lethal force. That what you're asking?

You referring to the guy with a BAC of just under .30% and Chantix in his system who assaulted his girlfriend and then went to a neighbors to pound on his door, was warned by the homeowner and then shot by that homeowner?Carter Albrecht, Amber Guyger, etc. lesson here measure twice, cut once.

I would think that too. But what would you do with a bowl of ice cream? He didn't lock his door. Also, did she really bang on the door saying let me in? If the door was malfunctioning and not closing why would she have to do that? I have walked to the wrong door before. Typically my first thought is “crap, wrong door” at the first sign of something being out of place, like a person eating ice cream on the couch that I don’t know.
I have no doubt she truly believed it was her apartment. But I am hesitant to think a reasonable person would have been so sure of that same belief. I just don’t know.
