Driving back to the house Monday and got a call that a few trees fell. Had 4 trees fall due to straight-line winds. This us my first time to deal with insurance since one tree wrecked the shop some. About 30 ft of roof needs to be replaced and 5 wall sheets and re insulated. Got it all clined up today and just waiting on the bid to see how bad it will cost.

Since the tree fell on a structure the cost of tree removal is covered by insurance. However your deductible still applies and I believe wind ded. is a % of the house insured value. Your work to remove the tree is not covered, insurance companies figure the homeowner works for free. Keep receipts for everything. If you buy a tool to help stabilize that is part of the loss. Did you need to buy a chainsaw? Did the truck get damaged? It is also covered under homeowners for this.

Wow Matt - was it Monday that they came down? I don't recall the winds that bad then. We've got a big one right next to the house that's lookin iffy...might need to take that out soon.

Didn't have to buy anything to remove it since I work in the forestry industry so I'll probably be at a loss on that part. Truck didn't get damaged so it is mainly the shop. I'll definitely will keep any receipts related to it though.

Thank you for the insight. This is my first to ever have to deal with insurance while being a home owner for the last 20 years.

Yes ma'am, my wife and I were driving home from jasper and our son called to say the trees fell and one on the shop and driveway was blocked by limbs. Tyler county EMS guy (a former Texas forest service guy) said he saw what looked like a tornado went over part of town and he agreed that this was straight-line winds probably off of it as it lifted and was north of our place. I definitely had been procrastinating taking this one down and that gamble was lost. Lol

Absolutely incorrect information in this post. If you remove the tree, cut the tree, clean up sewage, do temporary repairs, tarp a roof, anything as a homeowner or policy holder you're still eligible for coverage and payment for services performed especially if they're to minimize the loss or prevent further damages. Now you're not legally entitled to make a "profit" from any loss so sometimes that overall rate is adjusted downward to a homeowner's payment rate instead of paying a professional rate, but if they tell you "$0 because you did the work" thats bad faith and a slam dunk lawsuit. What you can do is bill it through your company at the retail rate if you owned/work for a tree cutting service and get paid a full amount that way.

Similarly, if you did have to buy equipment like a chainsaw, air conditioner, generator, or other necessary equipment, many companies will consider that "owner retained salvage". I've heard 50% of whatever the cost of the equipment is pretty much standard. Buy a chainsaw for $400, you use it to clean up the mess, get paid a homeowners rate to cut up a tree, they pay you $200 for the chainsaw itself and you keep it.

Another falsehood is the truck being covered. No homeowner's policy that I'm aware of pays anything for any vehicle under any loss. They'll point at the exclusions section and tell you to contact your auto policy carrier.

    Lots of luck with that...

The only words the "home owners scam firms" know here?

"ACT OF GOD!!! WE DON'T PAY!!" And by the way we are doubling your premium for having the nerve to file a claim. :50cal:

Any good firewood in there? Put up a free listing on marketplace for firewood. Let them get the big stuff and it's less to burn.

I'm not a public adjuster or attorney representing you, but I'll be happy to give you a nickel's worth of advice if you need it based on what the adjuster says/estimates.

I'm actually curious about that spray foam insulation, I would assume its repairable but I've also heard from many contractors say it has to be scraped off and re-sprayed. who knows.

You have a strong grasp of DTPA 21.21 -,203 and Title 5. Sub C. Chapter 541.
Perchance you dabble in this a bit?
