    Actually, Bexar, and it wouldn't surprise me if Travis county as well, are giving a pass on small amounts of not just hemp but MJ as well.

    However, as stated in my previous post, Guadalupe county is arresting everyone for everything including CBD and will be holding those charges to at least the end of the year in hopes of a way to test the stuff themselves or at least not by an outside contractor.

    However, looks like something is in the works for 2020...

    Yep travis county has started ticketing or destroying small amounts and some vape products that test positive. Field testing kits are notoriously un reliable in pos results for small amounts. Alot depends on the kind of kit. How the officer uses it, was he formally trained and several other legitimate issues good lawyers rightfully bring up. If there is no formal repeatable lab testing it can get sticky especially for jurisdictions that dont have their own labs or money to contract it out.

    Example, I have lots of experience with the NIK
    Testing kits. We've tested them, unscientificly, and the same small amounts of MJ from the same sample sometimes dont clearly test positive depending on how the officer uses it.

    You have to first break a glass vile of a "solvent" and agitate to release the THC before breaking another vile containing the "test" chemical that changes color when positive.
    Not following the directions and agitating properly can cause a false negative. Also sometimes MJ seeds wont test positive but IIRC at the time it was not designed for that. New tests are designed specifically for plant and seeds.

    CDB oil comes from hemp which is a totally different strain than pot.
    You could smoke hemp all day long and all you'd get is lung cancer.

    Actually Texas-legal hemp and Colorado-legal pot are the same plant.
    Same genus and species.
    Both Cannabis Sativa.
    It's just that one strain has been selectively evolved by humans to have very little psychoactive chemical production (<0.3%) and the other, similarly, has been bred to have 50 to 100 times as much.

    CBD is, quite likely, almost 100% placebo effect with the rare exception of childhood seizures and a few other select human afflictions.
    Mostly biologically inert and mostly harmless.

    Heck. A placebo that makes someone's back feel better is a damn lot safer that hydrocodone!!!
