    So says a panel of the United States Court of Appeals for the Sixth Circuit.

    Some of you folks may need to go buy some SCUBA equipment.

    To be clear, this is not final Case law, as case is headed back to the lower court.

    GOA just sent me this email. Said the 6th District court overturned the previous ruling.

    "This is fantastic news!

    Today, the U.S. Court of Appeals for the Sixth Circuit agreed with GOA on bump stocks.

    That’s right. The appeals court reversed an earlier district court decision which had denied GOA’s motion for a preliminary injunction.

    Court ruling: bump stocks are not machine guns
    This means that for the first time … anywhere in the entire country … a court has sided with a pro-gun organization against the ATF on their bump stock ruling which classified bump stocks as machine guns.

    This occurred yesterday when an appeals court agreed with GOA."

    who needs a bump stock when you can get a bump trigger lol.

    It forces the trigger to reset so it pushes your finger forward and if you are still pulling as soon as it resets it fires again with the next pull and so on.

    other than the price tag looks like it works as well as the bumpstock maybe a bit more accurate.

    Bump stock issue is more than is it a machine gun. It was confiscation of private property. Did anyone get paid for their bump stock? When the government uses eminent domain the landowner is paid for his property being confiscated.

    Despite there being other threads on bump stocks here and here and probably a dozen other places (Sic 'em, Cam!:)), I figure a new thread is warranted when the whole issue enters a new phase as it has just done.

    In case you haven't heard yet, a court has ruled that the method used (specifically, the reliance on Chevron deference) to ban bump stocks was wrong, implying that if bump stocks needed to be banned it was the job of Congress to do it with legislation, not the BATFE via (arguably, fixed) rule-making.

    The story is covered on Ammoland. I'm sure more in-depth analysis is in the offing.

    GOA has a suit in the 6th court. The appeals court only ruled that GOA is likely to succeed, and the trial court erred in not issuing the injunction. So it is back at the trial court. They will likely issue and injunction, which is moot as all of SlideFire's inventory has been destroyed and they OOB. Everyone else had a boating accident. Maybe they will go SCUBA and find those stocks.

    It is still a long way from "legal" and you can bet Feinstein has already added (if not there from day 1) bump stocks to her AWB.

    This only applies in the 6th circuit. Most of us are in Texas as was Slidefire and are in the 5th circuit. So our bump stocks are still contraband.
