    In Texas, is shooting - to kill - a person for rioting justifiable homicide, if the person shot actually dies, if they are not posing an imminent threat of serious bodily injury or death to an innocent party or if they are not committing arson (or about to do so) or robbing someone?

    1. The only reason you shoot someone is to stop the threat. That generally results in their assuming room temperature in a sooner than anticipated manner.

    2. By definition (and practice), a rioter is engaged in activity that includes arson, breaking and entering and acting in a willful manner in ways that present the real and present danger of death or seriously bodily injury to innocent 3rd parties. By what convoluted argument would you justify their actions?

    I have yet to see a RIOTER who is not out to kill you,harm you,destroy your property or burn you stuff to the ground.

    Seems like a reasonable assumption when 300 dudes march into your gated property. That they are there for harm and a free BBQ

    Glenn, In Texas, you can use up to deadly force to protect your property. Arson, would be considered a violent criminal act. If people are present in the dwelling at the time, a person could reason that they are in fear for their lives.

    I understood that about arson, what I was asking is absent those conditions (such as arson, robbery, burglary, a threat to your life): Can someone shoot to kill and be justified after actually killing someone because someone is rioting?

    Ummmm.....if they ain't committing arson, robbery burglary or being a threat to someone's life......they ain't rioting.

    Glenn, going by Cam's post, IF those persons were on YOUR property, (trespassing.) and standing there yelling at you, cussing you, and calling your derogatory names, (on your property!) what would YOU do?

    Personally, I would order them leave. The choice in which they leave would be up to them. In the scenario I just outlined, that person, or persons, would be considered a threat.

    Sadly, if you dust one of those pricks with a firearm you will be buying a lot of grief , bad press, lawyer $$, ect.

    Sadly, if you dust one of those pricks with a firearm you will be buying a lot of grief , bad press, lawyer $$, ect.


    I have a mob of 10+ people closing on me, all on MY property, while I'm armed in plain sight. If they continue to advance, I can easily justify being in immediate fear of my life. And frankly, I don't GAF about "bad press" - you have to be alive to see it.

    As for me, they would be getting a quick education .
