    A buddy of mine held a pistol for collateral and the guy defaulted on the loan.
    Turns out borrower likes the drugs and im wondering if that guns hot.
    Is it possible to check a serial # without raising red flags and stirring up a big mess?

    Later, if through investigation, they think you stole it...well...........

    Most stolen guns are not reported or the owner is unable to provide a serial number............

    Exactly. What if it does turn up stolen, will they arrest you on the spot?
    It is not unlawful to be in possession of stolen property unless you KNOW it was appropriated unlawfully.

    Texas Penal Code

    Sec. 31.03. THEFT. (a) A person commits an offense if he unlawfully appropriates property with intent to deprive the owner of property.

    (b) Appropriation of property is unlawful if:

    (1) it is without the owner's effective consent;

    (2) the property is stolen and the actor appropriates the property knowing it was stolen by another; or

    (3) property in the custody of any law enforcement agency was explicitly represented by any law enforcement agent to the actor as being stolen and the actor appropriates the property believing it was stolen by another.

    (4) "Appropriate" means:

    (A) to bring about a transfer or purported transfer of title to or other nonpossessory interest in property, whether to the actor or another; or

    (B) to acquire or otherwise exercise control over property other than real property

    YOU are wondering if it is stolen? Is your buddy wondering? What is your plan, to find out if stolen and then go to tell your buddy, or just dime him?

    Any used gun any of us buy including from a dealer could be a stolen firearm.....

    Pawn shops have to run their gun serial numbers weekly to the police when they buy one....so they do find out......

    The rest of us........

    Don't worry about it.....

    Just get the local LE to run the serial number. If it's stolen turn it in. I do wonder when folks say they don't want to get law enforcement involved?

    It isn't unlawful. If the gun is found to be stolen it will be confiscated, but there is little risk of arrest. If you have the gun, burglary tools, it's 2am and you are a block from the home where the gun was just stolen...well, yeah you might find yourself in jail.

    Comment was made that driving a stolen car is the same penalty as stealing the car.

    Just get the local LE to run the serial number. If it's stolen turn it in. I do wonder when folks say they don't want to get law enforcement involved?

    The PD doesn't have the time and resources for every person who wants a serial number of a gun ran.......they must have a legitimate reason to access the database, not hey, I got this gun from a drug abuser would you run it?

    They won't even run them for me....a gun shop......

    I just want to know.....is not a legitimate reason.........

    Ironically, this is a benefit of buying from a gun store or at least using the store for 4473/background checks. So many people say "what do I have to do to register/unregister my gun". It's not registered. BUT, I've had a few calls from ATF Trace where they find stolen guns and because I have it in my records, I can say who bought it. Likewise, if a customer has his guns stolen and he bought them from me, he can call me and I can pull his complete history with serial numbers.

    So background checks and FFLs and bound books are a bit of a blessing and curse. We don't want big brother in our business, but it helps when you need it.

    It's like the urban communities who want to shit on police...until their house is broken into or their wife is raped. Guess who they call...

    Its not like everyone has a camera on there cell phone and can snap a pic of the SN of the gun and save that file on a desk top. Its way to complex. Who has time for that.



    Or people could have personal responsibility and record their own damn serial numbers. Then I don't need big brother to take care of me should my gun be stolen, right?
