    If she is not "prosecuted", then there will be another unlucky guy some day who is going to get "persecuted."

    There is pattern forming in our society: three track justice system. One for rich and famous (never prosecuted) the every day citizen (sometimes prosecuted), a male for being male (99% persecuted) and then women who have an axe to grind (100% certain on all facts, recollections and memories).

    What happens with the $15,000 ‘Bond’ money that his mother had to put up (assuming the normal 10% bail bondsman fee)? Is that simply given back by the bail bondsman company? Or are they going to have to bring a lawsuit to recover that? Seems like he should be able to sue the “young lady” for some kind of damages.

    Doubt the fee is refundable.

    Good luck suing the accuser. You’d have to convince a judge the arrest warrant was based solely on her statement. I’d think the LE agency won’t release any of the case details until its closed, if even then.

    In a civil suit against the accuser, couldn't you get a jury trial?

    Yes. I just dumped a quick reply. At the gym.

    ETA: in either case, $15K isn’t small claims. Court costs and legal fees probably exceed the bail fee.

    Then, assuming a judgment in favor of the plaintiff occurs. It’s still got to be collected. Something tells me that would be hard to do.

    The real issue here is what other evidence did the LE agency have to support the arrest warrant.

    Most folks aren’t aware, but Williamson County has sentry plenty of folks to death row that were later exonerated. Sometimes after it was too late.

    I’ll have to dig up who all was involved, but there was a pretty big one in the news a few years back.

    Yeah, he’s 21 now and if graduated at 18, that would mean it’s been at least three years (if not longer). The girl just sounds “mental” to me... I suppose she cut her own ‘X’ too! Maybe she needs to be put on a ‘Red Flag’ warning too.

    In a manner of speaking, I’d say the boy “dodged a bullet” (pardon the pun) with that girl!
