    This is hardly Judge Benitez’s first foray into overturning laws infringing and impeding on 2nd Amendment rights. Benitez is the same judge who initially overturned both California’s ammo background check requirements and magazine bans. The overturning of the magazine capacity bans, known as Duncan v Becerra, was later affirmed by the 9th Circuit.

    Was right there in the article. They might have put a stay on the decision pending further appeal, but it appears they affirmed Benitez' decision in that matter as well

    From my understanding, the 9th circuit is due to take it up. Armed Scholar on youtube has a lot about this.
    Commiefornia is not a free state yet ( or perhaps ever ).

    If a commie state gets gun control knocked out our fellow citizens get their rights restored which is good for the country. Also sheriff of LA is going to start issuing concealed carry permits because of increased crime and police defunding. Small steps but important steps. It benefits us all to have California politicians shit on.

    The State will appeal and 9th circuit will knock it down. Always goes this way in Commiefornia.

    State will appeal. Partial panel will hear it. Decision depends on the specific justices. Goes to full panel, overturned. Goes to SCOTUS. Upheld 6-3 (Roberts knows it will win so he goes with the majority). Rejoicing in the land.

    mag ban was removed by a 3 judge panel of the 9th. It was then I am not sure if appealed is the correct term but its now going to face a full panel of judges from the 9th

    Where are you seeing that?

    Yesterday's Ammoland article quoted him recently saying,

    “We’re not going to go to ‘shall issue,’ where anyone who can fog a mirror can get a CCW permit,” he said. “That’s not responsible, but we do want to give people the opportunity – who are responsible, pass the training, that don’t have any convictions or legal limitations from being armed in public, and establish a ‘good cause’ reason why they should be armed, why we should trust them to be armed in public. That is the threshold.”

    Look at it this way - if California improves, Californians are a bit less likely to leave California and thus spread the California way to other states, which would be a good thing, right?

    It also means that our brothers and sisters in commie occupied territory will enjoy more of their "rights" as US citizens, and set the precedent to start removing unconstitutional and over-reaching laws nation wide. Those are good things as well.

    Whats that tired saying, as California goes, so goes the nation? If we keep California from going off the deep end, maybe we stay the tide of stupidity across the rest of the country? Wishful thinking, perhaps, but perhaps not. DJT was able to place members on the 9th, and despite his lack luster performance in some places, his judicial picks were above average and leaned toward liberty.

    Kangaroos are jumping up and down all over lefty land.
    Once again Trump was right to appoint so many judges. Don't know this one slipped by Georgie Bush. All his others were RINOS.

    magazine and gun bans are chasing the good californian people out, Its not stopping the Libs from abandoning ship.
