    He wore a mask went into the store and pointed a gun at thr clerk
    An armed customer in the store shot him cemetery dead

    Somebody had to do it, and since SAPD wasn't around this small gas station way out on the far west side, I don't see a problem with it. They just didn't want to say in the paper that this armed civillian did their job for them.

    SAPD showed up just in time to make a statement and take a report.

    If you were an armed citizen and saw the robber stick a gun in the face of the clerk, just a few feet from you and make a threat with the gun, then any reasonable person could feel that their life was also in danger.

    So he had the right to act under the law to protect the 3rd party and in fear of his own life. IMO

    I hope they didn’t take his gun, but I bet they did

    Never explain YOUR story to a cop.

    This is how it should go:

    Cop: So, what happened?
    You: "I was in fear of my life, and I defended myself"
    Cop: Ok, how did this play out?
    You: "I was in fear of my life, and I defended myself"
    Cop: You said that. Tell me how this developed
    You: "I was in fear of my life, and I defended myself"

    You get the script. All it takes is one a$$hat cop to misinterpret your story, write it wrong, and you are up a sh-creek without a paddle in court with differing scenarios.

    Anything on this side of heaven should be protected, and that includes someone else's life. The money is just that, cold cash... that can easily be replaced with insurance. Once that robber pointed a gun the scene became very real and the shooter had every reason in the book to put that perp down. What this cop is saying to the news is asinine and a half-truth, and is therefore a lie.

    Moral of the story, carry 2 guns. One you trust and depend on for your safety. The other a $25 Sat Night Special throwdown gun. Swap the 2 before the police arrive.

    Um, put much planning into shooting someone?
    Not like they aren't going to check ballistics....

    They conveniently left out that you can also legally defend a third party. Guess these cops would prefer to draw the chalk outline around the corpse of an innocent.
    It's a lot easier and usually less risky for them. They need to do whatever it takes to go home safe. No matter who has to die.

    Good job. The perp had a gun pointed at the clerk. That is deadly force. Use of Deadly force is authorized to stop the perp from harming somebody. The armed citizen followed the law.

    I've heard that the thing to say is "there was self-defense shooting". You may go to jail, but you didn't give them a major piece of evidence to incriminate you. If they can't even prove who did the shooting, they can't get you convicted. Or that's what I heard a lawyer say.

    They will be able to prove who did the shooting without difficulty.

    The why may be more difficult.
