    My understanding is that the Protection of Lawful Commerce in Arms Act does not apply as they are alleging that the Marketing was improper, as it was aimed at glorifying the death of humans, an illegal act.

    It does apply, and you can read it at 15 USC 105. I already covered this in post 28.

    They are claiming the SemiAuto Bushmaster is a military weapon, and should not be sold or marketed to civilians. The problems with this 1) There is nothing wrong or illegal about selling or marketing military firearms to civilians, just about everybody has a Glock 17, designed for the Austrian military. 2) A SemiAuto Bushmaster is not a military weapon.

    that is because refusing cert in this instance is a general precedent, not a case law precedent.

    As someone said, this precedent will open the floodgates for more lawsuits, now the lawyers see their suits will not be dismissed before trial.

    either way this will not be contained to CT, as I originally said before you decided to argue the multiple meanings of the word precedent.

    Except Baltimore can't even blame the advertising like Sandy Hook is doing. Even if they win and it is upheld at SCOTUS, they still won't have anything.

    The gangs are not stealing guns based on advertising.

    Suing eight gun manufacturers and gun shops in Nevada and Utah. Yeah, I don't see that going the long haul. Maybe they should sue the Hotel for being high enough to give the shooter a vantage point. The gun manufacturers didn't make the bump stocks. Where does it end?

    I know how these people feel. Losing a kid is hard and you want someone or something to blame. But blaming someone besides the killer is not the answer they seek.
