    Ok I have conflicting information on this so I'm asking here. I'd rather take all your words for it than a bunch of guys in the same building who seem not to know what's what.

    So. I have a pistol in SA. I need it shipped back her, to me, in El Paso. I don't want to go through an FFL. My brother has it by the way. If it HAS to be an FFL, I'll just wait till he can bring it when he visits.

    So the question is, and this is my understanding: He can ship it TO me, via UPS, undeclared as to avoid prejudice, as long as it is in state lines, from his UPS to my house?

    I know undeclared is probably agains policy and to be honest I don't give a shit as long as I'm not breaking any laws.

    I've had two ATF persons tell me yes, and then no. I scoured the internet and it seems like yes. I've gone over all of the policy BS with a UPS employee who informed me it would have to be hud to hud, if declared as a pistol.

    As stated, I just don't want to break the law. Hell, I send batteries through USPS. Shoot me...

    Sent a pistol to Armscor by FedX, just had to send it from a hub. They sent it back to me by FedX, to my door, I just had to sign for it. It is just personal property in Texas. As long as it is not logged into an FFL's A&D book anyway.

    Sent a pistol to Armscor by FedX, just had to send it from a hub. They sent it back to me by FedX, to my door, I just had to sign for it. It is just personal property in Texas. As long as it is not logged into an FFL's A&D book anyway.

    Only long guns can ship individual to individual in tx

    Is this coming from a place of not knowing, or is there proof to that? Everyone else says yes, so I just want to make sure you don't know something we're all missing. Either way, thanks for trying to help.

    Your brother has possession of the pistol. To transfer possession it must be done face to face in Texas.

    Sending it via common carrier is against the law.

    BTW, this topic has been discussed several times over at The High Road in the legal forum, a place where actual lawyers hang out.

    If that is the case, then I shipped my pistol to Armscor illegally and they shipped it back illegally. Not to mention that I told the Fedx folks it was a handgun and they did not care.

    Totally different situation.

    You were sending it in for repair. Armscor has a FFL.

    In the OPs case there is NO FFL. If it were a long gun there would be no problem.
