The law needs to expressly PROHIBIT police "taking" any otherwise private property from any civilian AND doing that should be a serious FELONY crime.
My first cousin was once (in NOV 2008) relieved of a Remington Model 572 pump-rifle that was MY personal property by a sheriff's deputy in Smith County, TX, who told my cousin that IF he "made a fuss" that he would be arrested & that drugs would be found in his PU.
When I went to discuss the situation with the deputy, he said, "Try & (obscenity deleted) prove in court that I took your (obscenity deleted) rifle. Best get out of my face before I lock your @ss up."
When I talked to his Captain with the SCSD about the incident, the CPT said, "And you can prove that our employee took your .22 rifle, by anything but your cousin's statement?"
I call that act, "Theft of a deadly weapon, by intimidation." = Anybody have a better description of that "unlawful taking", as neither my cousin nor I had done anything wrong??
(The deputy claimed that Randy "failed to signal a lane change" as the reason that he was stopped but gave him NO ticket for any offense. - not even a written warning.)
