    Carrier doesn't own the cell phone so they can't grant access. I assume you're meaning the call records? We've got decades of history on wire taps and call records, so I doubt call history is the issue. Perhaps cloud type backup of the actual data is in question?

    Per a 9-0 decision of the SCOTUS from the 1980s, there is NO "Right of Privacy to commit a felony".

    (Offhand, I cannot remember the case citation but it was in a huge marijuana dealing case, where the police wanted to access the criminal's phone records.)

    IF you were a VICIOUS CRIMINAL (especially a DEAD mass murderer!), YEP I would want the DPS, bearing a valid court order....

    With the court order, this is where it gets interesting. How far should they be allowed to go? Require a backdoor in all cell phones, or just access to what may be stored in carrier files and logs?

    Does any backdoor apply only to heinous felonies, or any and all crimes like texting while driving or walking on a sidewalk?

    ... Apple doesn't posses any software to unlock the phones they make because the very existence of such software would degrade the security they've worked very hard to provide.

    Just speculation on my part, but I bet they do. The same way all those internet sites can give you a "forgot your password" link.

    You're referring to what's called a brute force attack. Apple having foreseen such attempts, doubles the time you have to wait every time you enter the wrong code:

    I use the finger print reader to unlock my phone. Every now and then, no pattern that I can discern, and after reboots/power loss for sure, it asks for the PIN in addition (that's called two factor authorization).

    Not like they don't have his corpse, why not use his finger print?

    Fingerprint lock is an option and one that offers less protection. He may have not used it or his phone battery may have gone dead. In either case a pin would be required to unlock it. Fingerprint won't work when the phone is first turned on.

    I believe it's been rules that fingerprints locks aren't protected under the 5th amendment.

    Don’t think it works that way. Touch ID was touted as being safe from someone whacking a finger off and using it to access the phone. Something about there needing to be blood in there as well. No idea how accurate the claim or my memory is.

    Thought we went through this decryption mess after San Bernardino. If my memory serves correct, Apple claimed that it purposefully did not generate any software that could break the encryption on the phones. I think the court agreed that even with a valid search warrant the state could not force Apple to develop technology that would hurt their business. I also believe that they gave up access to any cloud data that the guys had stored. It was strange though that after all that legal hoopla, the FBI managed to find a company that accessed the data on said phone.

    Not really sure why the carrier is refusing to aid in the investigation. I would have to assume that if the cops had a valid warrant they would need to comply. I’m not aware of any legal reasons why they would be protected from having to share the info they have. I mean, weren’t ATT, VZ and Sprint outed as aiding in the various Echelon schemes cooked up by the fed gov. Maybe the feds don’t like the competition.

    Anyway. I agree with Apple and their stance that the information on my phone is mine and only mine. Given how many government agencies have been hacked and our private info stolen opening us up to ID thieves, it would only be a matter of nanoseconds before any backdoor keys would be for sale on the web.

    Because if it was powered off or didn't get unlocked for a certain amount of time, it still needs the PIN.

    I know there is an Israeli made device that can suck all data off a phone, but I don't know if it works with newer iPhones.

    On Monday’s broadcast of the Fox News Channel’s “Fox News @ Night,” Senator Ted Cruz (R-TX) criticized Democrats for filibustering the Grassley-Cruz legislation in 2013 that “would have resulted in this shooter being in federal prison instead of murdering those innocents in that Texas church.”

    Cruz said, “[T]his should have been stopped beforehand. Under federal law, it was illegal for this individual to purchase a firearm. He had a conviction for a crime that’s punishable by more than a year in prison, and he had a conviction for multiple domestic violence crimes. Both of those, it’s already ineligible. But, several things happened: Number one, the air force — the Obama administration didn’t report those convictions to the [NICS] database. That’s an endemic problem. It’s a problem with the federal government. It’s a problem with the states. And so, when he went in to buy the guns, they ran the background check, and they didn’t find it because it wasn’t in the database. But I’ll tell you we could have prevented this. In 2013, in the wake of Sandy Hook, I joined with Chuck Grassley, we introduced legislation that was called the Grassley-Cruz legislation. And it was aggressive legislation targeting felons and violent criminals to stop them from getting guns.”

    He continued, “There were a couple elements of that legislation that were critical: One, it mandated that federal agencies, including the Air Force, report to the [NICS] because that was a problem back then. But, two, and this is an even more critical piece, if it had been reported to the background database, when he went into Academy to buy this — these weapons, he lied on the forms. That is a felony to lie on those forms. The Obama administration didn’t prosecute those cases. In 2010, 48,000 felons and fugitives lied and illegally tried to purchase guns. They prosecuted only 44 of them.”

    Cruz concluded, “Democrats filibustered the legislation that would have resulted in this shooter being in federal prison instead of murdering those innocents in that Texas church.”

    Why? Because the simple fact is the anti-gun agenda is not about protecting the public. It is about destroying our Constitution.

    We JUST started watching that show. It’s like an X-files set in the 80’s. Husband is finding errors in the story line soundtrack clips that are not lined up right (show timeline wise) with the song release dates.

    But other than that, great show.

    And these pictures are REALLY making me enjoy a twisted and silly sense of humor this week which is very very much needed in light of things.

    IF someone came at me with a chainsaw it would probably scare me and shoot him before he got to me. If someone came at me with an AR it would probably scare me and I may duck before I shoot him. If someone came at me with a chainsaw/AR I would probably laugh before I shot him.
