    Two things come to mind reading this thread.

    First, how many times have I heard this sentiment, especially from those in law enforcement:

    "Ignorance of the law is no excuse."

    Second;

    "What is good for the goose is also good for the gander."


    LE should be held to the same or higher standard than the general population. Hopefully this is just a training issue with the individual officer and not a reflection of the entire departments attitude.

    Yep. How many of US could get out of so much as a speeding ticket with just an apology? Look, I'm not "anti cop", but I just think sauce for the goose should be sauce for the gander.

    As a former LEO I am of the opinion that " officer discretion " is being replaced with "blind loyalty to government." And a military loyalty at that.
    As for the ACLU, they would defend the officer. The officer would probably accept their defense because he doesn't have any money for a lawyer either.
    A fourth amendment violation needs to be adjudicated. Ignorance is not an excuse, not with the communications available to an officer today.

    I like your thinking.

    Maybe our OP should ask the PD to consider that for his girlfriend if they just choose to apologize and give his gun back.

    So what are the odds of them saying yes and lets just forget the entire thing:roflfunny:

    I don't think I have to say this, for the folks on TGT that know me, but for those that don't.....I am in no way, shape or form anti LEO, my posts #17, #58 & #60 were meant as support for being prepared, if need be, to take legal action with representation. Just the mindset of having things lined up if needed. Sorry if it was taken differently, that was not my intention.

    Hope the OP has a positive outcome to report later today....

    It went really well today. I went down there showed my CHL, ID, and the number the officer gave me. She went to the back and handed it to someone. We waited for about 10 minuetes when someone came out from the back. She put my revolver and ammunition on the table. She asked me to sign the propety reciet. She asked why I didnt tell the officer I was carrying. I told her what happened and she just shook her head. Said "have a nice day.".

    I'm glad everything went well. I will just chauk this up as an embarising and learning experiance for both me and the officer. I felt from her reaction she was gana have a word with him. While what he did wasnt right he is still a person and can make mistakes.

    Good! You're much more forgiving than I would be but, as long as the resolution is satisfactory to you, all is well.

    OP, I do not think for one second that the officer you retrieved the gun from will chastise the officer you dealt with. If you don't go to the chief, this will not change for the next guy.
