    Theft of Necessary Items

    Study after study shows that when we arrest, jail, and convict people for non-violent crimes
    committed out of necessity, we only prevent that person from gaining the stability necessary to
    lead a law-abiding life. Criminalizing poverty is counter-productive for our community’s
    health and safety. For that reason, this office will not prosecute theft of personal items less than
    $750 unless the evidence shows that the alleged theft was for economic gain.



    Driving While License Suspended (DWLI)

    Prosecuting a person for driving while their license is suspended is often just prosecuting a
    person for being too poor to pay off their fines and fees. I have developed a diversion program
    that will result in charges being dismissed for defendants who clear their drivers’ licenses.


    First-Offense Marijuana

    Although African Americans and people of other races use marijuana at similar rates, in Dallas
    County African Americans are three times more likely to be prosecuted for misdemeanor
    marijuana possession than are people of other races. After arrest, African Americans are
    assessed money bond at a higher rate for marijuana possession, and are assessed higher bond
    amounts than other races. African Americans are more likely to be convicted of marijuana
    possession once charged and are more likely to serve a jail sentence.1
    The District Attorney must take action to end that disparity. To that end, I have declined
    prosecution on misdemeanor possession of marijuana cases for first-time offenders whose
    offenses do not occur in a drug-free zone, involve the use or exhibition of a deadly weapon, or
    involve evidence of delivery. After the first offense, people will be offered a program that, if
    successfully completed, will keep their record clear. I am also in the process of dismissing all
    pending misdemeanor marijuana cases filed before I took office, according to the new policy
    stated above. To date, I have dismissed over a thousand misdemeanor marijuana cases.

    This is one of my favorite. Load up your shopping cart with groceries, and just leave without paying. No problem. Will be interesting to see how stores that have a "Do not detain, call police" policy will react.

    And will folks now have to pre-pay for meals in restaurants? Otherwise go eat, then get up and leave without paying.

    And just wait till someone determines an iPhone, 87 inch LED TV, etc., are "necessary items".

    Prosecuting theft is not criminalizing poverty. Most of the people caught stealing at Walmart have the money to pay for what they are stealing.
    Some of the poorest people I have ever known are some of the most honest also.
    Poverty has nothing to do with stealing. It is a mindset, not a money thing.

    So, let's see. If the Texas legislature passes that new bill that criminalizes the failure to report a stolen firearm, then the guy stealing your $700 pistol because he "needs" it won't be prosecuted. But if you fail to report it, then you would be prosecuted. Nice.

    Thieves not prosecuted, shops get stolen from until the close.
    All the shops close, no more theft to prosecute.

    And everyone lives happily ever after in poverty bliss.


    But at least the poor thieves don't get picked on by the rich shop keeper now
    now.

    What the **** is happening?

    I'm at a total and complete loss myself. When I first heard of this change in the law in CA....I mean, it's CA, but I was still kind of surprised. Somehow $950 or less sticks in my head for out there. But my first thoughts were people just taking things from people on the street, out of garages, stealing at the grocery store or any retail establishments, or anything of the like is essentially now perfectly legal.

    Then the opposite side of that, if someone tries to steal something of mine that can be deemed of need....which most things can, even guns, money, etc......and I either catch them and beat them to a pulp or shoot and injure or kill them in the process of their now noncrime and apparent new inherent right, then I can now be charged with assault, attempted murder or murder instead of previously getting off since I was defending myself or my property.

    I mean, Dallas is a cesspool, but I'm shocked this has come to Texas. Wonder what all the North Dallas liberal bubble crowd will think of it when they start getting their Rolexes stolen with no recourse.

    Of course the answer to all of this is social justice/social engineering.
